We will work on your project until you are completely satisfied. We build the song along with you and ask for your feedback at each step of the process. This prevents surprises and limits the number of revisions needed. We will continue, however, to make changes – big or small – until you’re completely satisfied.
If for any reason you decide we’re not the right fit and wish to cancel, we will refund your deposit. We will keep all files we created and you can not use anything we’ve created for you (recordings or ideas) in any way – but we’ll part ways with a smile. While we stand by our quality and commitment to the artist, we recognize that we will not always share the same vision – and that’s fine!
ROYALTIES & PUBLISHING
The total cost includes the recording fee and the producer’s royalty. Half of the Cost is the recording fee and half is the Producer’s advance.
Unless the artist chooses “No Split”, a royalty rate based only on net sound recording revenue will be paid to the producer if and when net sales exceed the producer’s advance.
Royalties are not debt to the producer. The royalty is only earned if net sales exceed the producer’s advance (half of the initial cost).
If we contribute significantly to writing your song (beyond the typical song development process in music production) appropriate publishing rates will apply.

ABANDONED AND COMPLETED PROJECTS
A project will be considered abandoned if we haven’t heard from you for over 30 consecutive days without prior notification. In this case, your deposit is non-refundable. If you choose to restart your project later, there will be a minimal $60 re-start fee.
A project is considered complete when your balance is paid in full. There may be additional charges to reopen a complete project including a re-start fee.
For small projects a deposit equal to 50% is due to book with the balance due upon completion. For large projects (EPs, ALBUMS) 50% is due to book with the balance due upon completion of each song -OR- 1/3 down to book, 1/3 payment at half-way point, and 1/3 upon completion.
We accept PayPal, all major credit/debit cards, cash and money orders.
We schedule on a first-come/first-serve basis. While we try to be as realistic as possible, we are usually working on several projects at the same time and can not guarantee a start or end date.
AS OF JUNE 2019 WE CAN START A SINGLE SONG +/- 2 WEEKS FROM TODAY OR BLOCK OFF EXCLUSIVE TIME FOR A LARGE PROJECT +/- 8 WEEKS FROM TODAY
When your project is finished, we will provide you with a Master recording of your project. If you would like additional files, stems, or mixes, please ask for them upon completion of your project.
Once your project is complete, we will keep your project in my system for 30 days. We will not be held responsible for file storage. While we try to keep archives of all projects, we will not guarantee against lost or corrupt data. At your request within 30 days of completion of your project, we will provide you with all relevant files for your project so that you can store them for no extra charge.
TERMS AND CONDITIONS
JONAH BROCKMAN/BRCKMN PRODUCTIONS agrees that all work from the inception through completion for the Client will be considered a “work made for hire” (see United States Copyright Act – Section 101) unless otherwise agreed upon in writing. All rights, title, and interest in each master recording which may be considered attributable to JONAH BROCKMAN/BRCKMN PRODUCTIONS will be deemed transferred to the Client by the agreement upon completion and payment of any outstanding balance.
All masters made under the agreement, from the inception of recording and any recordings derived therefrom, shall be the sole property of the Client, free from any claims whatsoever by JONAH BROCKMAN/BRCKMN PRODUCTIONS. The Client shall have exclusive right to claim ownership of and register the copyright to the master in his/her name throughout the world.
JONAH BROCKMAN/BRCKMN PRODUCTIONS waives the benefit of any provision of law known as “moral rights” or any similar analogous provision of any treaty, statute, regulation or rule of law of any government or quasi-governmental body in any country of the world or throughout the universe.
JONAH BROCKMAN/BRCKMN PRODUCTIONS will never sell, lease, or share ANY information provided by clients including contact information, song submissions, or any other private information.
The Client agrees that no recordings, ideas, or other work produced or performed by JONAH BROCKMAN/BRCKMN PRODUCTIONS may be used or shared publicly until all outstanding balances are paid for each project.
